1. Introduction
These Terms of Use (“Terms”) apply to all agreements between Popcorn Labs, Inc. (“Popcorn,” “we,” “our,” or “us”) and you, our customer (“you” or “Customer”). You are only allowed to use Popcorn's services if you accept these Terms.
2. Services
Popcorn is a licensed US carrier providing phone plans designed for global connectivity. To use our service, you will need to either download our mobile app or install an electronic SIM ("eSIM") that we provide. Our plans include voice, SMS, and data services.
While we aim to deliver reliable global connectivity, the availability and performance of our services may be influenced by factors beyond our control, such as local network coverage, geographic location, and technical limitations.
By using our service, you agree to use it solely for your personal benefit and not for resale or transfer to any other person or entity.
3. User responsibilities
You agree to prevent unauthorized access to your account and refrain from accessing or managing anyone else’s account without permission.
You are responsible for maintaining your account’s security and ensuring that your use is lawful and does not interfere with network performance for others.
Excessive or abusive use, including attempts to bypass network controls or use services beyond standard personal use, is prohibited. Failure to comply with these responsibilities may result in termination of services.
4. Account and service area
To use our services, you must create an account with accurate, up-to-date information, and be at least 18 years old. You are responsible for keeping your account details current.
Our primary service area is the United States ("US"), and we focus on supporting individuals with a US address. If you plan to spend extended time outside the US or are based outside of the US, please contact us to confirm if we can support your use case.
By registering, you agree to use your account solely for yourself and not share access with others. Popcorn is not liable for any losses or damages resulting from unauthorized access due to insufficient account security.
5. Pricing
Using our services may require a recurring monthly fee, billed according to your plan. Payments are due each billing cycle, and failure to pay on time may result in restricted access to certain features or suspension of your service. Your subscription will renew automatically unless you choose to adjust or cancel your plan.
We offer a free trial period of up to one week, allowing new users to try our services at no cost. If you wish to continue using our services after the trial, you will need to select a plan and complete payment.
Popcorn covers any applicable taxes or fees, though this may be subject to change based on service updates or legislation.
6. Fair use
Popcorn’s phone plans include international roaming to keep you connected wherever you travel, with no additional charges. To ensure a fair experience for all users, please follow our Play by the Rules policy, which is part of this agreement.
Our service is designed for typical mobile use, not as a replacement for home internet or sustained high data usage. Abnormal usage for us generally means data consumption above 50GB per month. If you approach this limit, you may receive an SMS alert and, if needed, experience temporary service limits.
You’re welcome to use our service for extended periods outside the US. However, if we detect misuse, we may reach out to discuss your usage and potentially suspend your account.
7. Privacy
We value your privacy and handle your data in line with our Privacy Principles. This policy outlines how we collect, use, store, and protect your personal information. By using our services, you agree to the data practices described in our Privacy Principles.
We take all necessary steps to secure your data, but please be aware that no method of transmission over the internet is entirely secure. For more details, please review our Privacy Policy, available on our website.
8. Limitations of liability
Popcorn shall not be liable to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from the use or the inability to use the Services.
Popcorn’s liability for any issues related to the services is limited to the extent permitted by law.
9. Modifications
Popcorn may update these Terms or make changes to our services from time to time. If we make significant changes, we will notify you in advance. By continuing to use our services after updates become effective, you agree to the revised Terms.
10. Termination
You may cancel your account at any time through our mobile app or contacting us. Popcorn also reserves the right to suspend or terminate your account if these Terms are violated or if misuse of the service is detected. If your account is terminated, you will be responsible for all charges incurred up to the termination date.
11. Dispute resolution
You may provide information and feedback concerning errors, suggestions for improvements, ideas and other matters related to our Services at hello@popcorn.space
If a dispute arises, we encourage you to contact us to seek an amicable resolution. Should resolution not be possible through direct communication, any disputes will be resolved through binding arbitration, with each party bearing its own costs unless otherwise agreed.
This process is intended to provide a fair and efficient resolution without resorting to lengthy litigation.
12. Final provisions
These Terms are governed by the laws of New York, without regard to its conflict of law principles. If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in full effect. Popcorn’s failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
